ScreepT - End User License Agreement

IMPORTANT! BE SURE TO CAREFULLY READ AND UNDERSTAND ALL OF THE RIGHTS AND RESTRICTIONS SET FORTH IN THIS END USER LICENSE AGREEMENT ("EULA").
YOU ARE NOT AUTHORIZED TO USE THIS SOFTWARE UNLESS AND UNTIL YOU ACCEPT THE TERMS OF THIS EULA.

This End-User License Agreement ("EULA") is a legal agreement between you and Alessio Moraschini (who's the author of this software, and, from now, referred as "Am-Design-development").

This EULA agreement governs your acquisition and use of our ScreepT software ("Software") directly from am-design-development.com or indirectly through a Am-Design-development authorized reseller or distributor (a "Reseller").

This "free" version of ScreepT is free of charge, and will always continue to be free unless you will choose to upgrade to Premium version, if and when it will be available. Additional limitations that are not present in this license may be introduced in the future.

Please read this EULA agreement carefully before to download, install, or update the ScreepT software. It provides a license to use the ScreepT software and contains warranty information and liability disclaimers.

If you are using a testing version (also known as "beta version"), of the ScreepT software, this EULA agreement will also govern that "beta version". By clicking "accept" or installing and/or using the ScreepT software, you are confirming your acceptance of the Software and agreeing to become bound by the terms of this EULA agreement.

If you are entering into this EULA agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity and its affiliates to these terms and conditions. If you do not have such authority or if you do not agree with the terms and conditions of this EULA agreement, do not install or use the Software, and you must not accept this EULA agreement.

This EULA agreement shall apply only to the Software supplied by Am-Design-development herewith regardless of whether other software is referred to or described herein. The terms also apply to any Am-Design-development updates, supplements, Internet-based services, and support services for the Software, unless other terms accompany those items on delivery. If so, those terms apply.

License Grant

Am-Design-development hereby grants you a personal, non-transferable, non-exclusive licence to use the ScreepT software on your devices in accordance with the terms of this EULA agreement.

You are permitted to load the ScreepT software (for example a PC, laptop, mobile or tablet) under your control. You are responsible for ensuring your device meets the minimum requirements of the ScreepT software.

You are not permitted to:

Permit the whole or any part of the Software to be combined with or become incorporated in any other software, at least you are not permitted to do this without a written explicit consent by the author Alessio Moraschini. For this kind of usage, an appropriate fee may be requested
Modify, decompile, or disassemble ScreepT executables, without a written explicit consent by the author Alessio Moraschini
Reproduce, copy, distribute, resell or otherwise use this distribution of the ScreepT Software
Use the ScreepT Software in any way which breaches any applicable local, national or international law
Use the ScreepT Software for any purpose that Am-Design-development considers as a breach of this EULA agreement

IMPORTANT: every change in ScreepT License introduced by Am-Design-development after that you have accepted it (this situation can happen when you update the software with the integrated ScreepT updater, or when you download a new version) implies that you will have to accept the new license in order to install the updates or to use the new version.
The software will automatically detect and show the new license, showing a pop-up window containing the new license, and you will have accept it as precondition to use the new version of ScreepT.
Furthermore, the following points marked with (*) may be applied in the future.

(*) It is planned to introduce a dual license for "free" and "premium" versions of ScreepT. After that, the current installation will continue to work as "free", and to use "premium"" functionalities of ScreepT, you will have to apply for a "premium" license.
(*) After the dual license for "free" and "premium" versions of ScreepT will be introduced, you may not be allowed for commercial usage of the "free" versions published after the introduction of dual license mechanism.

Intellectual Property and Ownership

Am-Design-development shall at all times retain ownership of the ScreepT Software as originally downloaded by you and all subsequent downloads of the ScreepT Software by you. The ScreepT Software (including the copyright, and other intellectual property rights of whatever nature in the ScreepT Software, including any modifications made thereto) are and shall remain the property of Am-Design-development.

Am-Design-development reserves the right to grant licences to use the Software to third parties.

Termination

This EULA agreement is effective from the date you first use, install, or download the ScreepT Software and shall continue until terminated. You may explicitly terminate it at any time upon written notice to Am-Design-development.

It will also terminate immediately if you fail to comply with any term of this EULA agreement. Upon such termination, the licenses granted by this EULA agreement will immediately terminate and you agree to stop all access and use of the ScreepT Software. The provisions that by their nature continue and survive will survive any termination of this EULA agreement.

Governing Law

This EULA agreement, and any dispute arising out of or in connection with this EULA agreement, shall be governed by and construed in accordance with the laws of Italy. Except for a request by OT for injunctive or other equitable relief, any dispute arising out of this EULA will be subject to the exclusive jurisdiction of the courts of Milan - Italy (IT).

IMPORTANT: ScreepT is built using different libraries licensed under permissive MIT, BSD(Default, modified, and 3-clause versions), and Apache licenses. You can find all informations about the libraries used in the root folder of the provided packaging you downloaded, inside the folder "Libraries_licenses". Furthermore, you can access and view them in the appropriate menu section inside the license acceptance window, accessible from both first launch and "help" menu section of the ScreepT Software.

THIS SOFTWARE AVAILABLE ON THE SITE www.am-design.development.com IS PROVIDED "AS IS" AND ANY EXPRESSED OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED. IN NO EVENT SHALL Am-Design-development, OR ANY OF ITS CONTRIBUTORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

Without limiting the foregoing, Am-Design-development makes no warranty that:

the software will meet your requirements.
the software will be uninterrupted, timely, secure or error-free.
the results that may be obtained from the use of the software will be effective, accurate or reliable.
the quality of the software will meet your expectations.
any errors in the software obtained from the am-design.development.com web site will be corrected.
Software and its documentation made available on the am-design.development.com web site will be up to date.

There isn't also any warranty that ScreepT is completely free of technical or other mistakes, inaccuracies or typographical errors. ScreepT creator may make changes to the software or documentation made available on its web site, either through manual download or with built-in update procedure. It is the user's responsibility to ensure that the software is updated with the latest patches in order to minimize any possible risk specified here.

That said, it's still possible that the material present on am-design.development.com may be out of date for some limited or unlimited periods of time: Am-Design-development make no commitment to update such materials in a constant and mandatory manner. Alessio Moraschini and its contributors assume no responsibility for errors or ommissions in the software or documentation available from the am-design.development.com web site.
In no event shall am-design.development.com or it's contributors be liable to you or any third parties for any special, punitive, incidental, indirect or consequential damages of any kind, or any damages whatsoever, including, without limitation, those resulting from loss of use, data or profits, whether or not Alessio Moraschini or its contributors have been advised of the possibility of such damages, and on any theory of liability, arising out of or in connection with the use of ScreepT Software.
The use of the software downloaded through the am-design.development.com site is done at your own discretion and risk and with agreement that you will be solely responsible for any damage to your computer system or loss of data that results from such activities. No advice or information, whether oral or written, obtained by you from Alessio Moraschini, its website, or its contributors shall create any form of warranty for the software.

Cryptography: Content may contain encryption software. The country in which you are currently may have restrictions on the import, possession, and use, and/or re-export to another country, of encryption software. BEFORE using any encryption software, please check the country's laws, regulations and policies concerning the import, possession, or use, and re-export of encryption software, to see if this is permitted.
